A fatal crash that left one former NHL player dead and another facing a four-year jail term is once again before the courts.
Rob Ramage, the one-time captain of the Toronto Maple Leafs, is appealing his conviction following a 2003 crash that killed his friend, former Chicago Blackhawk Keith Magnuson.
Lawyers for Ramage now say that his rights were violated while he was in hospital. A jury found him guilty of the following crimes:
- Impaired Driving Causing Death
- Dangerous Driving Causing Death
- Impaired Driving Causing Bodily Harm
- Dangerous Driving Causing Boldly Harm
His lawyers argue that Ramage's rights were violated when an officer collected a urine sample despite the fact that Ramage was on morphine, suffered a serious head injury, and couldn't give 'informed consent' to the officer.
Attorneys for the former Leaf say he should have a new trial, or have his current sentence reduced.
Ramage was handed four years in jail and a five-year driving ban, but is currently out on bail following the 2008 court decision
