The much-discussed proposal that will see motorists forced to use their hands for driving – not texting – will come into effect on Monday.
The new law makes it illegal for drivers to talk, text, type, dial or e-mail using hand-held devices while they’re behind the wheel.
Bill 118 applies only in Ontario, but it follows a precedent set by other provinces, including Quebec, Newfoundland and Labrador, and Nova Scotia. British Columbia is also expected to follow suit, with a law coming into effect February 1.
As of October 26, and up to February 1, 2010, Toronto Police will not be issuing tickets to wayward drivers. Those three months are considered an education period.
But after that, officers will have the ability to lay charges under the Highway Traffic Act and Criminal Code.
Those who ignore the rules could be fined as much as $500.
Although motorists won’t receive any demerit points under this specific law, they could be handed six demerit points if they are charged with the additional offence of careless driving
Police, paramedics and firefighters will continue to be allowed to use hand-held devices when performing their duties. All drivers may continue to use hand-held devices to call 9-1-1 in an emergency situation.
