Smoking Ban Challenge Lost

A challenge to the Manitoba's anti-smoking bylaw was tossed out of court on Thursday.

Treherne Bar Owner Robert Jenkinson was charged in November 2004 under the ban and decided to fight the charges.

Jenkinson's lawyer argued that the ban violates the Charter of Rights and Freedoms because it doesn't apply to native reserves, therefore creating an uneven playing field.

Provincial Court Judge Murray Howell ruled that this case doesn't amount to discrimination.
Jenkinson received a fine of about $2,500 which is relatively low considering there was 13 charges.

Chances are this isn't the end of the fight. Jenkinson's lawyer is filing an appeal at the end of the week.

The owner of Paddlewheel River Rouge Tours says weather also plays a huge role in his bottom line. Steve Hawchuk doesn't expect much from American tourists this year. 

"When the dollar was in their favour, they weren't coming out, so this year, I don't know what's going to happen. We'll know in another week or so but so far they haven't been coming," Hawchuk said.

The ummer tourist season truly begins when school ends next week.  That's when Hawchuk and others relying on tourist dollars can better guage what the season has in store.
